(e) a declaration of compliance drawn up in accordance with point (b) of paragraph 19(1) in relation to a domestic marine terminal. (documents safety documents) (e) the proposed hours of operation of the ferry cable; (b) has a significant economic interest in a patented device, apparatus, machine, subject-matter, patent or process, or part thereof, that is required or used by a ferry operator for the purpose of its equipment or services; 21.01 1. The Authority, as the sole voting shareholder of the ACFS, oversees the strategic direction of the BCFS in support of the public interest; including public interest in safe, reliable and affordable coastal ferry services in British Columbia. 10. The date on which the termination of a particular ferry service authorised under this Section is to take place may be less than one year after the date on which the final decision referred to in point (b) of paragraph 6 was taken, if the Commissioner considers that exceptional circumstances require that earlier date. In this case, the Commissioner must set the possible deadline for such termination as the date on which the designated ferry service must be discontinued. (2) The operator of a domestic marine terminal is deemed to be in compliance with the requirements of paragraph 1 if the Minister has issued a letter of approval for the ferry facility in accordance with subsection 352(1) of the Marine Transportation Security Regulations. Side note: Domestic ferries and domestic ferry facilities (a) have the same duty of care in respect of highway features leased to that ferry operator in a lease under section 31 as the Minister would have if those highway parcels were public highways, and 62 (1) If a ferry operator is of the opinion that the expenditures included by the Commissioner in a budget or tax request for a fiscal year, exceeds the amount that: The operator of the ferry may reasonably request that the costs referred to in section 57 be covered for that fiscal year; request that the matter be referred to arbitration by sending a notice ordering such arbitration to the Commissioner and the Minister within one month of receiving the request for a budget or levy. (2) The liquidator, liquidator, manager or other officer of a ferry operator or the person who seizes the property of the ferry operator is subject to the terms and conditions of the applicable inshore ferry service contract and shall act in accordance with this Act and with the Commissioner`s orders and directions, whether general or special, and without restriction. A reference in this Act to a ferry operator shall be read as a reference to the liquidator, liquidator, manager, officer or person seizing the property of the ferry operator. (b) within 6 months after receiving all the information required by the Commissioner in respect of the application, make its final decision to the ferry operator and the Government. (c) after reviewing a report or other record provided by the ferry operator to the Commissioner under this Act, the Commissioner is of the opinion that the ferry operator does not or cannot provide one or more of the basic ferry services.
8 No person in charge of the ship shall steer the ship by means of a ferry cable when the red lights at the ends of the ferry cable are shining ashore. Without limiting the generality of paragraph 2, the liquidator, liquidator, manager, officer or person seizing the property of the ferry operator, and any person acting under the authority of the operator, shall obey the orders of the Commissioner within the Commissioner`s jurisdiction and the Commissioner may enforce the Commissioner`s orders against that person, even if the court appoints or acts under its supervision.
