Under 18 U.S.C. 922, individuals convicted of certain offenses, including domestic violence, and persons subject to a Pennsylvania Abuse Protection Order (PFA) may be prohibited from possessing a “firearm.” The term “firearm” is defined in 18 U.S.C. 921(a)(3) as follows: To restore a person`s constitutional right to possess a firearm, the person may apply for a pardon for the conviction. A pardon quashes the conviction in principle, and the annulment of the conviction also lifts the ban on weapons based on that conviction. Quite simply, because the conviction causes the prohibition, the annulment of the conviction lifts the prohibition.
